House sale blocked by covenant

Posted on June 26th 2009

A Dorset family has been refused the right to sell their home because of a covenant which prohibits sale of the property to anyone not from Dorset.

Philip Collins had agreed to sell the Dorchester property to a Scottish couple for £192,000 after lowering the asking price from £217,000.

However the Synergy Housing Group, which owns the estate on which the former council house is situated, moved in to block the sale.

Mr Collins fears that the legislation will make it very difficult to find a buyer.

The covenant is part of the Margaret Thatcher’s Right to Buy legislation introduced in the 1980s.

A spokesman for Synergy Housing Group, Brian Miller, said: “It [the covenant] was there when they purchased the property and they should have been aware that there may be these issues on re-sale.”
